Kamo Kitchens Limited Full Terms and Conditions 

1. Scope of works 

Project Overview: Kamo Kitchens Limited will provide cabinetry design, manufacture, and installation services as per the agreed-upon plans, and specifications outlined in the contract. ● Materials: All materials used will conform to the specifications provided and be agreed upon by both parties before the commencement of the project. 

2. Changes to design & Late amendments 

Client-Initiated Changes: Any requested changes to the design or scope of work after the project has commenced (contract signing) must be requested in writing. Any request will incur a $150.00 admin fee before we will explore the requested changes with you and provide any cost implications. All work on the project will halt until the changes have then been accepted or declined. 

Change Approval: No work on the requested changes will begin until the client has approved and signed the variation form and paid the subsequent costs involved. 

Time Implications: Any changes made may cause a delay in the project completion. Kamo Kitchens Limited is not liable for any such delays or additional costs arising from the accepted or declined changes. All and any costs incurred, indirectly or via subcontractors, will be accepted by the client. 

3. Installation Delays 

Delay Due to Customer: If the client delays an agreed installation date by 3 days or more (e.g., by not having the site prepared), Kamo Kitchens Limited reserves the right to not automatically accept a reschedule at the next available date and instead has the ability to reschedule when time allows, without causing an unnecessarily long delay. Kamo Kitchens Limited will not be held accountable for any additional costs incurred due to these delays. If delays in installation become greater than 15 days Kamo Kitchens Limited reserves the right to charge to the client storage fees for the holding over of the manufactured units. 

Unforeseen Circumstances: Delays caused by unforeseen circumstances such as weather, material shortages, or third-party delays will be communicated promptly with the client. While Kamo Kitchens Limited will endeavour to eliminate delays, we are not responsible for any costs or consequences arising from them. 

4. Final Site Inspection 

Inspection Process: A final site inspection will be conducted upon the completion of the installation. The client must attend the inspection to review and sign off on the work completed. ● Approval and Sign-Off: Upon signing off, the project is considered complete, and any remaining 

balances are due. Should any defects or issues be identified during the inspection, they must be noted and will be addressed by Kamo Kitchens Limited. 

5. Owner’s Care & Maintenance 

Care Instructions: The cabinetry requires general care and maintenance. This involves (but is not limited to) general cleaning of the units and components, not overloading or forcing systems to operate above recommended guidelines, and operating the hardware in an unsafe or improper way. Failure to follow these instructions may void any warranties. 

Cleaning Products: The use of harsh chemicals or abrasives on cabinetry surfaces can lead to damage. The client is responsible for using appropriate cleaning methods and products on their cabinetry surfaces. If more information is needed the client can contact Kamo Kitchens Limited in the first instance.

Environmental Conditions: Kamo Kitchens Limited is not responsible for damage caused by excessive moisture, humidity, or temperature fluctuations in the home. 

6. Payment Terms 

Deposit/Progress & Final Payments: Specific amounts and percentages as laid out in the contract. The deposit of 50% of the total contract price is required to secure the project and materials. This deposit is non-refundable once materials have been ordered or custom work has begun. 

Late Payments: Any late payments beyond 14 days after the job has been completed may incur interest charges at a rate determined by Kamo Kitchens Limited (between 5 - 10%) per month. Failure to make payment may result in legal action or debt collection services being contacted. Any additional costs incurred by Kamo Kitchens Limited as a result of these services will also be passed on to the client. 

7. Warranties & Liability 

● Warranty: As per Kamo Kitchens Limited Warranties document found on our website. 

● Liability: Kamo Kitchens Limited is not responsible for any damage to the property or other items caused by factors outside of our control (e.g., structural issues, electrical and/or plumbing issues discovered after demolition, improper client maintenance, etc.). 

8. Site Preparation 

Customer Responsibility: The client must ensure that the site is safe and ready for installation. This includes having the cupboards empty and cleaned, no excessive clutter in adjacent spaces, appropriate ventilation, access to usable bathroom facilities. Failure to do so will result in delays and additional costs. 

Access to the Site: The client must ensure that there is safe and unobstructed access to the worksite during agreed installation hours. 

9. Disputes 

Resolution: Any disputes or disagreements should first be addressed in writing to Kamo Kitchens Limited. Both parties agree to attempt to resolve disputes maturely through negotiation before pursuing any legal action. 

10. Cancellation Policy 

Customer Cancellation: If the client cancels the project after work has commenced or materials have been ordered, they will be liable for any costs incurred by Kamo Kitchens Limited up to the point of cancellation. 

Company Cancellation: Kamo Kitchens Limited reserves the right to cancel the contract in cases of non-payment or violation of the agreed terms. Any work completed up to that point will be charged accordingly.

Warranty Coverage 

Effective Date: Date of completed installation. 

Warranty Period: As outlined by the Consumer Guarantees Act 1993 (CGA). 

What is Covered 

● Workmanship: Kamo Kitchens Limited warrants the workmanship and installation of its cabinetry and services as stated in the Consumer Guarantees Act 1993. This covers defects resulting from poor construction or improper installation. 

● Materials: We provide a warranty of 1 year on the materials and components used in your cabinetry, including: 

○ Drawer runners and components 

○ Hinges and lift systems 

○ Board products 

○ Storage systems and solutions 

○ Handles 

Although some hardware components (like Blum Hardware) offer other greater warranties over and above this. 

What is not Covered 

This warranty does not cover: 

● Normal wear and tear, including scratches, dents, or fading due to sunlight exposure. ● Damages caused by misuse, abuse, neglect, or improper maintenance. 

● Issues resulting from water damage, excessive heat, or environmental conditions (e.g., humidity). ● Modifications, repairs, or alterations made by anyone other than Kamo Kitchens Limited. ● Damage caused by improper use of cleaning chemicals or abrasive materials. 

Claims 

To submit a warranty claim, please contact Kamo Kitchens Limited as soon as practical. You will need to provide the following information: 

● Proof of purchase (copy of invoice or contract) 

● Description of the defect or issue 

● Photos of the problem 

Claims Process: Once a claim is submitted, we will review and may schedule an inspection. If the issue falls under warranty, repairs or replacements will be made at no cost to the customer within a reasonable time frame. 

Exclusions and Limitations 

This warranty is non-transferable and applies only to the original purchaser. Kamo Kitchens is not responsible for any incidental or consequential damages. This warranty does not affect your statutory rights under consumer protection laws.
